研一的刑法各论课堂上，李立众老师向我们提问：“为何民事法律不承认事实婚姻，但刑法中的重婚罪却对事实婚姻进行处罚?”当时的课堂讨论氛围很是激烈，现在想来似乎大家都没能很好地理解李老师问题的内涵。时延安老师也同我们探讨了“帅英骗保案”罪与非罪的认定。可以说，正是这两个话题使我开始了对刑民之分的思考。经过我的导师付立庆老师的提示：民刑之分是一个很大的话题，可以尝试从比较小的角度例如违法性的研究作为毕业论文的选题。但知识储备和知识结构本身不足使得我还是不能够驾驭刑民违法性这样的难题，最后只得再一次缩小研究范围，将一个总论问题具化到分则，探讨权利行使行为与敲诈勒索罪的界分。
