浅析海运提单的风险及防范措施[摘要] 海运提单在国际贸易中具有非常重要的地位和作用, 这是由它的性质所决定的。提单是货物所有权的凭证,谁控制了提单, 谁就拥有了该批货物的所有权。然而, 在国际贸易中, 提单的使用也带来种种风险。通过对海运提单的风险作了深层次的分析, 提出相应的防范措施。[关键词] 海运提单防范措施风险海运提单( bill of lading, B/L) 是国际货物海上运输中的重要单据之一, 我国《海商法》第72 条规定: “提单是用以证明海上货物运输合同和货物已经由承运人接收或者船, 以及承运人保证据以交付货物的单据。”《汉堡规则》第1 条第7 款给提单下的定义是: “提单是证明海上运输合同和货物由承运人接管或装载以及承运人保证凭以交付货物的单据。提单的作用主要体现在三方面: 1、表示货物的收据, 证明承运人或其代理人已按提单所列内容收到货物; 2、表示货物所有权的凭证, 收货人或提单的合法持有人有权凭提单向承运人提取货物, 也可以在载货船舶到达目的港交货之前办理转让, 或凭以向银行办理抵押贷款; 3、表示托运人与承运人之间订立运输协议的证明文件, 是他们处理双方在运输中权利和义务问题的主要依据。另外, 海运提单也是出口方在信用证项下向银行交单议付的最重要单之一,在所有的运输单据中, 也只有其才能代表运载货物的所有权, 并能自由转让和流通。“树大招风”, 海运提单在国际贸易中的重要性, 被一些不法分子瞄准、利用。近几年来, 国际贸易中出现了许多伪造、篡改海运提单以取货款的案例。而且,随着我国外贸的不断发展、信用证的不断推广使用, 海运提单的案例更是层出不穷, 技巧也日新月异, 有越演越烈之势。因此, 很多外企单位将海运提单风险防范工作列上日程。一、海运提单常见的风险类型防范于未然, 在国际贸易中海运提单存在的风险主要有:( 一) 倒签和预借提单已装船提单应在货物全部已装上船后签发, 签发的日期必须是真实的, 因为提单的签发日期即视作装运日期。如果提单在货物装船后签发, 签发日期却早于实际装船日期, 便构成倒签提单。如果货物尚未全部装船或货物已由承运人接管尚未开始装船的情况下签发了提单, 便构成预借提单。倒签提单或预借提单, 托运人的目的都是为了使提单签发日期符合信用证规定, 顺利结汇, 但对收货人来说则构成合谋欺诈, 可能使收货人蒙受重大损失。对此, 各国法律和海运习惯都是不允许的。( 二) 伪造提单提单是信用证所要求的主要单据, 在信用证业务中, 只要单据符合信用证的要求, 银行即凭单付款, 而不审查单据的来源及其真实性。一些不法商人即利用信用证“单据交易、严格相符”的特点伪造提单, 以取货款, 可能货物根本没有装船,或以次充好, 蒙客户, 从而给企业带来重大损失。( 三) 以保函换取清洁提单在国际贸易中, 经常会出现这种情况: 承运人欲对表面状况不良的装运货物签发不清洁提单, 由于银行不接受不清洁提单, 托运人不能凭此结汇, 因而往往向承运人出具保函( LETTER OFINDEMNITY) , 让承运人签发清洁提单, 并保证赔偿承运人因签发清洁提单而受的损失, 以此来换取清洁提单, 顺利结汇。可见, 出具保函是出于国际贸易的需要, 从某种意义上讲托运人和承运人都能得到一定的方便和好处, 但实际上对承运人来讲却潜伏着很大的风险。一旦收货人持清洁提单向承运人索赔, 承运人必须赔付收货人。但承运人持保函向托运人追偿时, 是否能得到补偿, 则取决于托运人的信誉和需要补偿的理由是否与保函中所保事项完全一致。且承运人没有按照货物的实际情况签发提单, 已违背了民事活动诚信的原则, 往往构成与托运人串通, 对善意收货人进行欺诈, 如承运人提请诉讼, 根据法律, 任何有欺诈性的合同、协议或保证都不具有法律上的约束力, 因此法院不会以保函为依据来判决保函项下发生的货损货差的责任方, 承运人因收货人或提单持有人赔偿而遭受的损失不能向托运人追偿。( 四) 无提单放货_海运提单是物权凭证, 货物运到目的港后, 承运人有义务将货物交给正本提单持有人。然而在实际业务中, 有时会发生货物先于运输单据到达的情况, 在与日本、韩国、香港及东南亚等近洋地区的贸易中屡见不鲜。由于收货人手头没有正本提单, 无法及时提货转卖或销售, 会产生货物压仓费用、品质变化、市场价格波动等一系列问题。碰到这种情况, 习惯上都是通过担保提货的方式予以解决的。即由收货人向船公司提供一份经银行会签的书面保函, 要求在没有物权凭证的情况下先提货日后补交提单。但如果承运人将货物交给非正本提单持有人, 有可能造成错误交货构成对提单持有人的侵权。在无提单放货过程中, 提取货物的不一定是买卖合同的买方, 有可能被冒领, 提货人往往不易查明, 也会有船方偷货的可能。因此无提单交货风险是很大的, 船务代理凭保函放货, 而不是凭提单放货, 这是一种揽险自危的行为。二、提单风险的防范措施( 一) 杜绝或从严掌握预借和倒签提单倒签或预借提单办理结汇, 有损外贸企业形象及外运公司信誉, 并可能造成经济损失。目前我国港口拥挤, 船期不准是客观情况, 出口公司在签约、订舱、交货时需充分考虑到这些因素。同时应加强对合同履行各个环节的管理工作, 加强与有关部门的配合, 必要时应事先设法取得客户的配合。如不得已“预借提单”时, 则要注意防止发生实际装货船舶与“预借提单”的船名不相符合的情况, 如因无舱位或货物迟延而改装了另一条船。一旦发生这种情况, 则应采取紧急措施, 果断追回全套单据, 重新缮制, 决不可有侥幸心态。因为, 从法律责任看, 出口方预借提单结汇已构成伪造装运日期, 一旦另一方查明事实真相, 违约方须承担一定法律责任。如出口方提供了装于甲船“已装船”的“清洁提单”, 而货物却装上乙船, 无需细查, 即可证明出口商预借了提单, 仅凭这一点,进口商就可据此拒付货款并提出索赔。而“倒签提单”属托运人和承运人合谋欺收货人的行为, 因此受害方可以追究卖方的责任, 而且还可以追究承运人的责任。这种行为的法律后果无论对卖方还是对承运人都是严重的。为预防发生倒签提单, 出口商应对有关装运期规定有一个准确的认识。例如: 国外信用证时常有以下一些关于装运期的用语: ( 1) Latest: 31,July, 即最迟不晚于7 月31 日, 包括7 月31 日; ( 2)Not later thanJuly 31, 不迟于7 月31 日, 包括7 月31日; ( 3)During first half of July, 表示从7月1 日至7 月15 日, 包括起止日; ( 4)Within July, 即During July, 从7 月1 日至7 月31 日, 包括起止日; ( 5)At the end ofJuly, 从7 月21 日至7 月31 日, 包括起止日; ( 6)On or before July 31, 表示7 月31日之前, 包括7 月31 日; ( 7)On or aboutJuly 31, 表示7 月31 日前后5 天内, 即从7 月26 日至8 月5 日止。出口商应严格按信用证规定装运, 从正当手段获得装船清洁提单, 以维护良好的信誉。( 二) 印刷和使用难以伪造的提单国际海事局提议, 印制和使用难以伪造的提单, 控制其流通。提单的纸质、式样都应有明确、严格的规定。( 三) 选择资信好的交易伙伴在国际贸易交往中, 对客户的资信情况全面了解是保障业务顺利进行的先决条件。若由于对交易伙伴的资信情况没有进行很好的调查和了解, 仅凭熟人介绍或贪小便宜与之成交, 则往往容易出事, 后悔莫及。所谓资信情况好, 包括两个方面:一是资产情况好, 有相当可观的资产, 且经营状况好, 有履约能力; 二是能在诚实信誉的原则上履约, 不会随意撕毁契约。
( 四) 严格海运提单的签署信用证业务是纯粹的单据交易, 银行承担其付款责任的唯一条件是受益人提交了符合信用证条款的单据, 只要单据表面满足“单单相符, 单证一致”的条件, 银行就担付款责任。而不管单据的真假与否, 如果单据出现不符点, 对出口方来说,就丧失了安全及时收汇的银行保证。对进口方来说也会造成不同程度的损失。( 五) 选择可靠的船公司( 承运人) 运载货物根据目前航运界状况要完全禁止保函的使用是不易的, 因此, 选择可靠的承运人则至关重要; 装船时承托双方都要谨慎, 力争做到出现问题早发现, 及时解决,避免出保函; 承托双方对保函的出据和接受也要慎重, 以便在保函项下发生损失时易于协商解决; 由于保函具有承托双方合伙对第三者收货人欺诈的性质, 因此, 应十分注意选择可靠的承运人运载货物。( 六) 积极运用法律手段, 及时要求海事司法保护寻求海事法院的保护时应注意: 第一, 发现外方有迹象时, 及时向海事法院提起诉讼。因为有时一旦国外不法商人的行为得逞, 我方就无处寻觅行人, 即便能够找到, 他也不会轻易应诉, 不会轻易执行判决。以伪造单据为例,如果行人伪造的全套单据( 包括提单)完全符合信用证的要求, 根据《UCP500》惯例, 议付行即应履行付款义务。若赶在银行付款之前亦即方得到货款之前,及时向海事法院提起诉讼则可避免损失该货款; 若在付款之后才向法院起诉, 行商可能已逃之夭夭, 法院作出判决也无法执行。第二, 提出诉讼保全措施, 这是使不法外商目的不能得逞的重要措施。申请诉讼保全后, 海事法院及时对者所有或标的物实施扣押或冻结, 确保日后对案件司法判决的实际进行。但是, 如果提出的诉讼保全是冻结信用证项下的货款, 则该请求必须在银行承兑之前提出, 因为在远期信用证付款情况下, 如果银行已承兑了汇票, 则银行在信用证项下的责任就变成了汇票项下的无条件的付款义务, 法院也就无权对该货款实施保全措施。纵上所述, 海运提单的使用存在较大潜在风险, 外贸从业人员必须认真对待,严格掌握, 谨慎处理, 将风险防患于未然。参考文献:[1] 任丽萍,陈伟.国际贸易实务[M].清华大学出版社.[2] 跟单信用证统一惯例[M].国际商会第500 号出版物,1993.[3] 陈志友.进出口贸易实务[M].立信会计出版社.财税金融

The cynics say we care for nothing other than grades; and we neglect the need for character cultivation. But again, the cynics are wrong. We care deeply for each other, we cherish freedom, we treasure justice, and we seek truth.
Last week, thousands of my fellow students had their blood type tested in order to make a contribution for the children who suffer from blood cancer.
As college students, we are adolescents at the critical turning point in our lives. We all face a fundamental choice: cynicism or faith, each will profoundly impact our future, or even the future of our country. I believe in all my fellow classmates. 二、春节的习俗
1、腊月二十三 祭灶
我国春节，一般是从祭灶揭开序幕的。祭灶，是一项在我国民间影响很大、流传极广的习俗。旧时，差不多家家灶间都设有“灶王爷”神位。
2、腊月二十四 扫尘
“腊月二十四，掸尘扫房子” ，据《吕氏春秋》记载，我国在尧舜时代就有春节扫尘的风俗。按民间的说法：因“尘”与“陈”谐音，新春扫尘有“除陈布新”的涵义，其用意是要把一切穷运、晦气统统扫出门。这一习俗寄托着人们破旧立新的愿望和辞旧迎新的祈求。 每逢春节来临，家家户户都要打扫环境，清洗各种器具，拆洗被褥窗帘，洒扫
六闾庭院，掸拂尘垢蛛网，疏浚明渠暗沟。到处洋溢着欢欢喜喜搞卫生、干干净净迎新春的欢乐气氛。
3、腊月二十五 接玉皇
旧俗认为灶神上天后，天帝玉皇于农历十二月二十五日亲自下界,查察人间善恶，并定来年祸福，所以家家祭之以祈福，称为“接玉皇”。这一天起居、言语都要谨慎，争取好表现，以博取玉皇欢心，降福来年。
4、腊月二十七、二十八 洗浴
传统民俗中在这两天要集中地洗澡、洗衣，除去一年的晦气，准备迎接来年的新春，京城有"二十七洗疚疾，二十八洗邋遢"的谚语。腊月二十六洗浴为“洗福禄”。
5、腊月三十除夕 贴门神、贴春联、守岁、爆竹、吃年夜饭、给压岁钱、祭祖
除夕的意思是“月穷岁尽”，人们都要除旧部新，有旧岁至此而除，来年另换新岁的意思，是农历全年最后的一个晚上。故此期间的活动都围绕着除旧部新，消灾祈福为中心。
春联、贴福字、贴窗花、贴年画、贴挂千。这些都具有祈福、装点居所的民俗功能。反映了人民大众的风俗和信仰，寄托着人们对未来的希望。
守岁，我国民间在除夕有守岁的习惯，俗名“熬年”。守岁从吃年夜饭开始，这顿年夜饭要慢慢地吃，从掌灯时分入席，有的人家一直要吃到深夜。守岁的习俗，既有对如水逝去的岁月含惜别留恋之情，又有
对来临的新年寄以美好希望之意。
爆竹，中国民间有“开门爆竹”一说。即在新的一年到来之际，家家户户开门的第一件事就是燃放爆竹，以哔哔叭叭的爆竹声除旧迎新。爆竹是中国特产，其起源很早，至今已有两千多年的历史。放爆竹可以创造出喜庆热闹的气氛，是节日的一种娱乐活动，可以给人们带来欢愉和吉利。王安石的《元日》诗：
爆竹声中一岁除，
春风送暖人屠苏。
千门万户曈曈日。
总把新桃换旧符。
描绘了我国人民欢度春节盛大的喜庆情景。
在古代的农业社会里，大约自腊月初八以后，家庭主妇们就要忙着张罗过年的食品了。因为腌制腊味所需的时间较长，所以必须尽早准备，蒸年糕，年糕因为谐音“年高”，再加上有着变化多端的口味，几乎成了家家必备的应景食品。年糕的式样有方块状的黄、白年糕，象征着黄金、白银，寄寓新年发财的意思。年糕的口味因地而异。
饺子，北方年夜饭有吃饺子的传统，但各地吃饺子的习俗亦不相同，有的地方除夕之夜吃饺子，有的地方初一吃饺子，吃饺子是表达人们辞旧迎新之际祈福求吉愿望的特有方式。饺子就意味着更岁交子，过春节吃饺子被认为是大吉大利。另外饺子形状像元宝，包饺子意味着包住福运，吃饺子象征生活富裕。
吃年夜饭，也叫团圆夜，离家在外的游子都要不远千里万里赶回家来
是春节家家户户最热闹愉快的时候。大年夜．丰盛的年菜摆满一桌，围坐桌旁，共吃团圆饭，心头的充实感真是难以言喻。
给压岁钱，压岁钱是由长辈发给晚辈的，有的家里是吃完年夜饭后，人人坐在桌旁不许走，等大家都吃完了，由长辈发给晚辈，并勉励儿孙在在新的一年里学习长进，好好做人。
6、正月初一 拜年
春节早晨，开门大吉，先放爆竹，叫做“开门炮仗”。爆竹声后，碎红满地，灿若云锦，称为“满堂红”。这时满街瑞气，喜气洋洋。 春节里的一项重要活动，是到新朋好友家和邻那里祝贺新春，旧称拜年。新年的初一，人们都早早起来，穿上最漂亮的衣服，打扮得整整齐齐，出门去走亲访友，相互拜年，恭祝来年大吉大利。拜年的`方式多种多样，有的是同族长带领若干人挨家挨户地拜年；有的是同事相邀几个人去拜年；也有大家聚在一起相互祝贺，称为“团拜”。由于登门拜年费时费力，后来一些上层人物和士大夫便使用各贴相互投贺，由此发展出来后来的“贺年片”。春节拜年时，晚辈要先给长辈拜年，祝长辈人长寿安康，长辈可将事先准备好的压岁钱分给晚辈，据说压岁钱可以压住邪祟，因为“岁”与“祟”谐音，晚辈得到压岁钱就可以平平安安度过一岁。

i think my dad was a hero for me when i was a young child. we'd go fishing, walks, and other fun things for a kid.
every child has a good and great father, and so do i. my dad played a very important role in my daily life`````exactly speaking, in my past 16 years.
my father always stands in the center of my life， from past till now and possibly in the future.
my family was rather poor when i was in my childhood. we didn't have our own house and had to live in a shabby， small room rented from my father's factory. the room was so small that there was little space for people to walk. i didn't have my own bed and had to sleep with my parents. this is terrible both for my parents and me.
but father made this all different!he works very hard on his own business, now we have our own 2 housese,surly,i have my own room.and he take our family so much happiness, richer and richer.
when i was little, i did everything with my dad. you could always find me sitting on his knee or walking and doing everything with him. every night he would read me a bed time story and make the voices of each character.
i learnt a lot from my daddy. i learnt to never take things to seriously and to always smile.

first of all, let me take this chance to present to you a set of data that i hope won't bore you since the source is china daily.
china's tourism revenue last year reached 500 billion rmb, an increase of 10.5 percent from the year before, and comprised more than 5% of china's gdp. according to experts, this number will grow to 8% in the coming ten years and more than 40 million jobs will be created.
as a student majoring in economics, i can't be more sensitive to the essential meanings behind these numbers. they mean progress, prosperity, employment and stability.
however, as a conscientious chinese and citizen of the world, i can't help but care more about the losses incurred in this transaction, by which i mean the disturbing images of environmental destruction, which leads to ecological crisis. the global environment has changed for the worse during the past few years, and tourism is partly to blame. take china for example, in order to attract tourists, many unknown places are built into resorts. forests are cleared, prairies trampled, rivers and lakes 6)contaminated, wild animals are driven away, plants jeopardized and secluded populations disturbed.
if this seems too remote and abstract, my own traveling experience may speak louder here. last year i took a tour around emei mountain in sichuan province. like most tourists, i was eager to embrace nature and enjoy its beauty. however, as soon as i got on the bus, the stench of gasoline and the noise of the engine tainted my appreciation of the wonderful scenery and the tranquility of the country road. when we finally arrived, what i saw was not a beautiful landscape but crowds of people; what i heard was not the melodious singing of birds, but yelling and bargaining from the gift shops; what i smelled was not the fresh mountain air, but stinking suffocating smoke coming out of small dirty restaurants. moreover, i could not understand why the lovely monkeys living there had to take photos with tourists all day; why the beautiful butterflies and flowers had become lifeless samples in shop windows; why the strongest impressions i had was trash scattered everywhere on the ground.
however, this is not the end of the story. before i left emei, i met a group of kids in an ecotourism program with the slogan: “experiencing, learning and protecting.” when i saw their young hands picking up trash from the ground, when i felt their enjoyment and harmonious relationship with the animals, when i found their purest eyes filled with passion and love for nature, i realized to my great satisfaction that there doesn't have to be a tradeoff between tourism and ecology, because deep within us is an inclination toward natural beauty and a desire to protect it. yes, environmental problems will eventually ease with the advancement of science and technology and improvement of our management system. however, an increase of ecological education and hands-on environmental involvement of our fellow citizens will do even better. to realize this, the best way for us lies in tourism itself because nothing other than nature can teach us how to love and cherish our sweetest home. at the end of my speech, please let me quote bob dylan:

When I came to Wantirna College first time, I met liz collar who is international student coordinator. She is very kind to me, and she encourage me join SRC, I went to SRC meetings regularly all the time, but I didn’t even know what SRC was! He spent nearly all the money on games, which was earned by his father's selling blood. When his father knelt down to beg him to return to school, he was too numb to show any regret.
The most serious harm of computer games come from their contents, which affects teenagers ' mental health. Many games involve violence, such as fighting and killing. When they enjoy the pleasure of success, a violent turn of mind is developed and rooted in them, which may induce future violent behaviour in their life.
So when computers' entertaining function is highly spoken of ,such a problem does deserve our serious concern.

动物实验是医学研究常用的方法和手段，在人类疾病的调查和防治研究等诸多方面发挥着巨大作用。目前，国内外公认实验动物质量的标准化与否直接影响着科学研究水平的高低，实验动物水平应当与科学研究的水平相匹配。因此，人们愈来愈重视实验动物的标准化问题。但是，医学研究论文中对实验动物应用状况的描述尚未引起人们足够的重视，而描述的状况既从一个侧面反映了实验动物应用的情况，也反映了科研论文的规范化程度〔1〕，并进而影响论文的质量和交流。作者通过对《中华医学杂志》、《中华内科杂志》、《中华结核和呼吸杂志》、《中华病理学杂志》、《中华肿瘤杂志》、《中国病理生理杂志》、《中国应用生理杂志》、《解放军医学杂志》、《第三军医大学学报》和《第四军医大学学报》1991～1996年各期刊载的呼吸系统疾病论文为例进行调查，并随机抽检了《Respiration Physiology》、《European Respiratory Journal》、《American Review of Respiratory Disease》及《American Journal of Respiratory and Critical Care Medicine》中应用实验动物的文章。填写问卷，依文献计量学方法进行统计分析，结果如下： 1.10种杂志文献中呼吸疾病所占数量有明显差异，平均占总量的12.93%。其中《中华结核和呼吸杂志》中呼吸疾病占80.31%，《中华内科杂志》中占11.57%，《中华肿瘤杂志》中占10.11%，《中国病理生理杂志》中占9.55%，比例较高。《中华病理学杂志》中占7.96%，《中华医学杂志》中占4.81%。《中国应用生理杂志》中占5.54%。而《第三军医大学学报》中占3.73%，《解放军医学杂志》中占2.31%，《第四军医大学学报》中占2.53%，比例较小。 2.约有1/4的研究论文是通过动物实验进行研究工作的，几乎涉及呼吸系统的各种疾病，主要以阻塞性肺气肿、肺原性心脏病、支气管哮喘、呼吸衰竭、肺癌为主。几种杂志不平衡，《中国病理生理杂志》所占比例高达75.25%，《中国应用生理杂志》所占70.27%，比例较高，《第四军医大学学报》为62.07%，《第三军医大学学报》为48.00%，《中华医学杂志》为32.76%，《解放军医学杂志》为18.52%，《中华结核和呼吸杂志》为13.15%。而《中华内科杂志》和《中华肿瘤杂志》较少，分别为7.74%和8.60%。这与各杂志刊文的侧重点有关。 3.理想的动物模型应是规范化的，能够准确地重复再现。为此，应严格控制影响因素，力求一致性。影响复制的因素可分为两大类：动物因素和环境因素。动物因素包括遗传因素、性别、年龄、疾病因素。环境因素包括营养、气候、理化、居住因素。因此，研究论文中对这些因素均应描述。调查中发现文章标题作为研究核心，有39.08%的文章没有注明实验动物的种名，有些文章应用了不规范的俗名，如“大白鼠”、“小白鼠”等。24.43%的文章没有交代实验动物的品系、品种。57.47%的文章既不记叙实验动物的来源，也不交代其遗传背景。性别、年龄和体重因素，分别有31.32%、99.13%和13.79%的文章无记叙。一些文章实验动物的数目偏少，不足以达到统计学的要求。有11.78%的文章甚至未提实验动物的数目。当然，近交系动物可以突破统计学上的要求，但也必须满足一定的数目。 4.动物实验的条件：98.56%的文章根本不提及饲养方式，99.14%的文章对实验环境未记叙，仅有1篇文章(占0.29%)提到了实验动物的合格证。有5篇文章是应用裸鼠进行的实验，其中仅1篇提及动物实验条件。 5.动物实验的处理方式：为不影响实验结果和操作者安全，以及减少动物模型处理因素的干扰作用，对实验动物进行恰当处理是必要的。调查中发现，57.76%的文章未记述麻醉剂，72.41%的文章未记述处死方式。有较多的文章写着“处死后……”，但未谈如何处死。有86.78%的文章叙述了施加实验因素时所采用的方式，有61.49%的文章记述了所用动物模型的制法或依据，考虑到了采用不同的模型处理的结果会完全不同，如何实施实验因素的方式是应当记叙的，但该调查中发现竟有13.22%的文章未谈及。 6.动物实验设计的问题：动物实验设计也应当参照并遵守临床实验设计的三大原则〔2〕：随机化、重复、对照。根据实验动物的情况，有时还应当在最后采用双因素方差分析。调查发现，45.40%的实验未随机分组，19.54%的实验未设对照，全部文章均未使用双盲法或采用双因素方差分析。因此，在实验设计上尚有值得改进的地方。 客观地讲，目前我国应用实验动物的水平与发达国家(如美国，日本)还有一些差距，因为实验动物的应用情况，受到国家相关的政策法规、经济发展水平及科学技术水平等多重因素的影响。从随机抽检的文章〔3～5〕中可以看出，国外几种与呼吸疾病相关的杂志对实验动物的描述具有以下特点：(1)品种、品系描述清楚；(2)强调来源；(3)体重明确；(4)等级明确；(5)饲养环境和实验环境明确；(6)性别明确；(7)有对饲养方式的描述(如饲料类型、营养水平、照明方式、温度、湿度要求)；(8)所用动物数量准确；(9)对动物的健康状况的描述详细；(10)对动物实验的处理方式有单独清楚的交代；(11)全部有对照，部分采用了双因素方差分析。当然，国外杂志有些文章也有不足，比如对动物年龄描述不够明确，也未见使用双盲法。发达国家目前动物检测工作有专门的机构，可以保证试验结果的可靠性。 随着实验动物质量不断提高，动物实验条件的不断改善，动物实验应用领域也愈来愈广泛。但是，许多动物实验研究论文中往往将试剂生产地、产品批号等描述十分详细，而对实验动物的条件却记述很少，甚至一些学术水平很高的科研论文，对实验动物方面的记述也很简单。这种状况应当引起广大科技人员的重视。

我的论文题目是《我国汽车出口贸易现状及对策分析》。
这篇论文是在我的指导老师xx老师的悉心指点下完成的，在这段时间里，刘老师对我的论文进行了详细的修改和指正，并给予我许多宝贵的意见和建议。在这里，我对他表示我最真挚的感谢和敬意！下面我将这篇论文的写作研究意义、结构及主要内容、存在的不足向各位老师作简要的陈述，恳请各位老师批评指导。
首先，我想谈谈为什么选这个题目及这篇文章的研究意义。
我当时之所以选择《我国汽车出口贸易现状及对策分析》这个题目是因为近几年来，尤其是加入WTO之后，我国的汽车出口贸易进入了一个市场规模、生产规模迅速扩大，中国汽车出口贸易的快速增长，引起了世界对中国汽车业的关注。中国的自主品牌已成为国际汽车市场上一股不可忽视的力量。全面融入世界汽车工业体系的时代，中国现已成为具备完整的汽车工业生产体系的生产大国，汽车产品出口方面也取得了很大进步，呈现出自主品牌出口占主导地位的新特点。在经济危机的影响下，中国汽车产品出口形势不容乐观，缺乏规模经济、产品科技含量低、售后服务体系不健全等问题仍然存在，在国际市场竞争日益激烈的情况下，制定中国汽车出口的长远发展策略是当前亟待解决的问题。研究中国目前汽车出口的现状，根据汽车出口贸易的总额和特点，研究分析当前中国汽车出口贸易存在的问题，并提出解决的措施，有利于中国汽车出口贸易向一个良性的趋势发展，有利于中国对外经济和贸易的发展，同时有利于塑造我国对外的一个更好的形象。
其次，我想谈谈这篇文章的结构和主要内容。
我的论文主要分为以下三个部分：
第一部分通过海关总署汽车出口贸易总额的数据，分析近几年来汽车出口贸易的特点及其出口优势。近几年来，我国汽车出口贸易的主要特点表现在：汽车产品及整车出口加速；自主品牌汽车成为出口主力；出口市场多元化态势；出口规模加大、向发达国家延伸；我国汽车出口贸易的优势主要表现在三个方面，分别是：后发优势、低成本优势、企业产品出口意识不不断的增强。
第二部分找出了汽车出口贸易中存在的问题，通过综合各种贸易总额数据和各种文献以及自己的思考，我认为中国汽车出口贸易主要存在以下三个方面的问题：缺乏规模经济；缺乏自主品牌；服务体系不健全。
第三部分是基于问题提出的对策分析，主要从政府和企业两个层面，提出了相关的对策分析。
政府方面的对策主要有：加快国内汽车企业的兼并重组，实现规模经济；整顿出口秩序，规范出口行为；引导强化企业自主研发能力；加强物流业发展。企业方面需要主要是：提升自主的研发能力；研发和推广新能源汽车；重视产品的售后服务。
我的论文结论是：我国汽车出口贸易存在许多优势，但同时也存在许多的问题，我们需要政府和企业共同努力，解决好汽车出口贸易中存在的问题和缺陷，进一步提高我国汽车出口贸易的核心竞争力。
最后，我想谈谈这篇文章存在的不足。
在这篇论文的写作过程中，我尽可能多的收集资料，虽然从中学到了许多有用的东西，也积累了不少经验，但由于自己学识浅薄，认识能力不足，在理解上有诸多偏颇和浅薄的地方；也由于理论功底的薄弱，存有不少逻辑不畅和辞不达意的问题；加之时间紧迫和自己的粗心，与老师的期望相差甚远，许多问题还有待于进一步思考和探索，借此答辩机会，万分恳切的希望各位老师能够提出宝贵的意见，多指出这篇论文的错误和不足之处，我将虚心接受，从而进一步深入学习研究，使该论文得到完善和提高。

飞速发展的信息技术正在引起社会的深刻变革，已经到来的信息时代迫切要求教育进行改革，教育技术已成为教育改革的制高点和突破口。《国家基础教育课程改革纲要（试行）》中明确提出：“要大力推进信息技术在教学中的普遍应用，促进信息技术与学科课程整合，逐步实现教学内容呈现方式、学生学习方式、教师教学方式和师生互动方式的改革，充分发挥信息技术的优势，为学生的学习和发展提供丰富多彩的教育环境和有力的学习工具。”这为信息技术在学科教学中的运用以及信息技术与学科教学的整合指明了方向。
信息技术与学科教学相结合就是以学科知识作为载体，把信息技术作为工具和手段渗透到学科教学中去。小学科学课程标准指出：在一切有条件的地方，科学课程的教学应尽可能地运用现代教育技术。信息技术与小学科学整合可以丰富学习的资源，学习的形式更加多样，学习的安排更加灵活，将更加有利揭示教学重点，突破教学难点。有利于加强教学的直观性，使知识、能力、兴趣融为一体。易于学生接受，有利于激发学生的学习积极性，培养他们学科学的能力。
因此，对信息技术与小学科学教学的整合进行研究，能为对小学科学教学提供参考，为更有效地培养学生的科学素养提供事实和理论依据。
随着信息技术的发展，信息技术与小学教学整合已经成为社会与时代的发展的必然趋势。信息技术与学科教学整合也取得了一定的成果，但研究者主要关注信息技术与小学语文、数学、英语教学的整合研究。在信息技术与小学科学整合上，多集中在多媒体与小学科学结合来改进小学科学教学和信息技术与小学科学课程的整合问题上。缺乏对信息技术与小学科学教学的整合研究。
本文共分成四部分：
第一部分主要阐述了信息技术与小学科学教学整合的内涵和意义，旨在增加对信息技术与小学科学教学整合的理解。
第二部分主要以xx市xx区为例阐述了信息技术与小学科学教学整合的现状。主要存在以下一些现状：教师整体的信息素养水平不高；信息技术在小学科学教学中的应用不高；为“整合”而整合；对“整合”的理解走入误区；过分强调“亲历”的“不可替代性”，并对对上述的现状进行了原因分析，教师信息技术水平的影响，科学教学软硬件条件的缺乏，教与学缺乏探索求新的意识，对新课程标准的认识度不深，是产生上述现状的原因所在。
第三部分主要阐述了信息技术与小学科学教学整合的切入点，本文提出了主要在情境教学、信息的收集与处理处、模拟仿真、虚拟实验这几个方面来进行整合。

我叫xx，本次论文指导老师是xx老师，我选的毕业论文题目是《提升xx省出口优势产业集群竞争力的对策研究》，下面我先汇报一下自己选择这篇论文的动机以及论文选题背景、基本写作思路、理论与实践意义。
先来陈述一下我的写作动机。我来自xx，在没写这篇论文之前我仅知道xx各地存在生产相同产品的特色乡镇，比较熟悉的有临海的太平洋彩灯城、xx的的服装机械、xx的阀门等等，根据20xx年底的统计数据，其中阀门水泵占全国出口的60%以上，缝纫机和电动裁剪机在国际上占有70%的市场份额等等。而xx，众所周知是一个贸易大省，我想出口与产业集群应该有醒目的联系，所以，我就选择了《提升xx省出口优势产业集群竞争力的对策研究》，一方面是希望通过这篇论文能让自己更加清楚的了解xx省出口优势产业集群的分布、现状及国际竞争力，二则因为自己属于国贸专业，也希望以后能从我省的优势产业集群中挖掘更多的商机，为自己的未来作些理论的铺垫。
其次，我要陈述的是本篇论文的主要论点及结构。虽然这篇论文的选题有点长，但我觉得中心还是应该扣在最后的几个字上，即“集群竞争力的对策分析”。所谓“产业集群”，是指在某一产业的上下游企业在一定区域内大量集聚，形成了竞争优势的经济群落。北京大学教授王xx在论坛中指出，提高出口竞争力的关键是发展富有特色的产业集群，力避产业集群的同质性的重复建设。因此，我的论文从浙江省出口优势产业集群的发展现状和主要特点着手，力求寻找到我省出口优势产业集群具有优势的软硬件基础。我总结出来的几点是规模喜人、产业结构合理、产品分工细致、出口竞争优势显著等。
在论证xx省出口优势产业集群竞争力及其竞争优势的时候，我主要分析xx省产业集群的几个关系，比如企业集聚与生产效率、国际竞争力的关系，集群竞争力与竞争压力、创新能力的关系，“区位品牌”与集群竞争力的联系等。而出口优势产业集群竞争力的决定因素也常规的从国家层面、集群层面、企业层面“先大角度再小口径”地分析。
这篇大学生毕业论文对xx省出口优势产业集群竞争力指标分析也主要集中在第三部分，这也是我对策研究的理论根据。其中包括集群占xx省近几年六成左右的主要经济指标。xx省03~06年的进出口额，xx省出口优势产业集群中主要企业在各地区的分布情况，例举xx民营中小企业对海外市场进入方式偏好，而竞争力指标也主要围绕贸易竞争力指标（TC指数），出口分散度等进行论述。并进一步提出浙江省出口优势产业集群竞争力的制约因素。这些都是浙江省出口优势产业集群竞争力的对策提出的基础。
论文的重心也是通过以上的分析来给出提升xx省出口优势产业集群竞争力的对策。我借鉴了大学经济类科目的主要归纳方法，分别从政府、企业、行业协会三个角度来提出相应的对策。也可以说是宏观与微观对策的双重分析来应答如何提升浙江省出口优势产业集群竞争力。
在写完这篇论文的时候，自己感觉条理上还不是很严谨，出现了一些观点的重复，对一些具体数据的收集还有许多不足，使得这篇论文在对浙江省出口优势产业集群竞争力的的思考还停留在比较粗浅的层面，不论在理论方面，还是在实践方面都有许多问题需要继续进行深入、细致地探索。但也因为通过写这篇论文使我对浙江的出口优势产业集群的分布、产业集群状况及出口总体概况有了大致的了解，大学本专业所学的部分知识也重新被认识与肯定，因此也可以说一篇论文使我受益匪浅。

首先，我想谈谈这个毕业论文设计的目的及意义。我们都知道在现代市场经济环境下，企业间的竞争日趋激烈，企业为了在竞争中赢得主动，抓住商机，除了要提高产品质量、改善售后服务外，还要运用赊销方式来扩大销售。赊销在这方面有着任何其他结算方式都无法比拟的优势。特别是在信用经济时代下，由于信用交易体系的不断发展，信用交易额度不断增大，大量使用现金交易显然无法满足日益扩大的市场规模的要求。同时企业扩大市场规模，提高产品或服务的市场占有率，增加企业的盈利水平，特别是在宏观经济不景气、市场疲软和资金匮乏的情况下，赊销具有比较明显的促销作用，更是一种抢先占领市场的重要手段，有利于扩大企业产品的销路，增加了产品销售收入，提高企业竞争能力和经济效益，同时我认为最值得关注的是赊销形成应收账款的弊端，应收账款不仅会增加管理及其他方面的成本，还有可能形成呆账、坏账，导致企业现金流紧张，甚至陷入财务危机，增大经营风险。从以上可知应收账款是一把双刃剑，它能为企业带来丰厚的利润，也能将企业带来破产的困境。目前我国大部分企业对应收账款管理意识较薄弱，对企业应收账款管理研究具有重大意义。
其次，抛开论文引言部分，我想谈谈这篇论文的结构和主要内容。第一部分是有关应收账款的理论综述。第二部分是应收账款管理存在的问题。第三部分是加强应收账款管理的对策。第四部分是四川长虹案例分析来了解应收账款的管理。
最后，我想谈谈这篇论文存在的不足。书到用时方恨少，事非经过不知难。这篇论文写作的过程，也是我越来越认识到自己知识与经验缺乏的过程。虽然，应收账款是一个简单的会计科目，但是当我尽可能地收集材料，竭尽所能运用自己所学的知识进行论文写作的时候，发现原来简单的东西里面蕴含着丰富的知识，在此过程中我学到了很多东西，但论文还是存在许多不足之处，比如说我应该对账龄分析放和坏账的计提做一个介绍，尽管文章有涉及但还是有待改进，请各位评委老师多批评指正，让我在今后的学习中学到更多。

我是xx学院中文系汉语言文学专业xx级x班的学生xx。我的论文题目是《卫斯理系列科幻小说的创作特点》。卫斯理系列科幻小说在科幻小说界的地位毋庸质疑，其奇特的构思、丰富的想象力，渊博的知识和深度的思考，深深地吸引了一批又一批的读者。作为与金庸同为香港四大才子之一的倪匡所缔造的“卫斯理”神话，有必要在文学界引起重视并加以研，但是当前而言，研究工作极其零散，毫无系统性，甚至可以说是空白。
在着手准备论文写作的时候，我重新大量阅读了卫斯理系列经典小说。对卫斯理系列科幻小说做进一步的了解，缕清思路的基础上，确定论文大致思路和研究方向。为了完成论文，本人收集了大量的文献资料，其中主要来自网上的论文期刊、图书馆的书目、学习教材的理论资料和卫斯理中文网。
在xx导师的指导和帮助经过阅读主要参考资料，拟定提纲，写开题报告初稿，毕业论文初稿，修改等一系列程序，于xx年5月20日正式定稿。
具体来说，我的论文分为以下四个部分：
第一部分，主要概述了卫斯理系列科幻小说审美特征上的通俗性，，在阐释上首先指出了科幻小说的审美特征，然后针对卫斯理系列科幻小说的审美特征做进一步探讨，得出其小说的幻想性远大于科学性的写作特点。
第二部分，针对卫斯理系列科幻小说的故事内容进行探讨，综合分析作者倪匡创作时在科学与幻想上的优劣，得出其在故事情节的创作上更具的特色，即其故事性强，背景宽广，情节曲折离奇，引人入迷。
第三部分，主要是论述了卫斯理系列科幻小说中体现出来的新的写作手法，即“倪式故事新编”。本部分主要是通过对部分的卫斯理系列科幻作品展开分析，总结出这一创作特色。
第四部分，对卫斯理系列科幻小说的创作主题和作品中人物进行探讨，从三个小的方面具体分析得出卫斯理系列科幻小说作品主题复杂多样、主要人物的单一性、人物塑造各具特色。
第五部分，主要是深入挖掘作品在创作中体现出来的对自由平等及人性方面的思考，从小说思想意义的高度，对小说的创作进行分析。
经过本次论文写作，我学到了许多有用的东西，也积累了不少经验，但由于学生能力不足，加之时间和精力有限，在许多内容表述上存在着不当之处，与老师的期望相差甚远，许多问题还有待于进一步思考和探索，借此答辩机会，万分恳切的希望各位老师能够提出宝贵的意见，多指出本篇论文的错误和不足之处，学生将虚心接受，从而进一步深入学习研究，使该论文得到完善和提高。

1、毕业论文答辩的应付步骤：（1）要写好毕业论文的简介，主要内容应包括论文的题目，指导教师姓名，选择该题目的动机，论文的主要论点、论据和写作体会以及本议题的理论意义和实践意义。（2）要熟悉自己所写论文的全文，尤其是要熟悉主体部分和结论部分的内容，明确论文的基本观点和主论的基本依据；弄懂弄通论文中所使用的主要概念的确切涵义，所运用的基本原理的主要内容；同时还要仔细审查、反复推敲文章中有无自相矛盾、谬误、片面或模糊不清的地方，有无与党的政策方针相冲突之处等等。如发现有上述问题，就要作好充分准备——补充、修正、解说等。只要认真设防，堵死一切漏洞，这样在答辩过程中，就可以做到心中有数、临阵不慌、沉着应战。（3）要了解和掌握与自己所写论文相关联的知识和材料。如自己所研究的这个论题学术界的研究已经达到了什么程度?存在着哪些争议?有几种代表性观点?各有哪些代表性著作和文章?自己倾向哪种观点及理由；重要引文的出处和版本；论证材料的来源渠道等等。这些方面的知识和材料都要在答辩前做到有比较好的了解和掌握。（4）论文还有哪些应该涉及或解决，但因力所不及而未能接触的问题，还有哪些在论文中未涉及到或涉及到很少，而研究过程中确已接触到了并有一定的见解，只是由于觉得与论文表述的中心关联不大而没有写入等等。（5）对于优秀论文的作者来说，还要搞清楚哪些观点是继承或借鉴了他人的研究成果，哪些是自己的创新观点，这些新观点、新见解是怎么形成的等等。2、毕业论文答辩是一种有组织、有准备、有计划、有鉴定的比较正规的审查论文的重要形式。为了搞好毕业论文答辩，在举行答辩会前，校方、答辩委员会、答辩者（撰写毕业论文的作者）三方都要作好充分的准备。在答辩会上，考官要极力找出来在论文中所表现的水平是真是假。而学生不仅要证明自己的论点是对的，而且还要证明老师是错的。

I remembered that when I come here first time, there is a party in the house of my home stay. During the time, they played jokes and they laughed all the time, do you know how embarrassed that is, everyone laughed except you. So I pretend to understand the joke in another party, I saw everyone laugh and I laugh too in 5 seconds later. My home stay was surprised about that and asked me “do you understand?”， and I answered “no”， “So why do you laugh?” ”because I do not want to be embarrassed”!
But as I receive this award today, I want to thank to them, because they encourage me to be involved with the committee rather than staying in at home, play computer and speak Chinese.
When I came to Wantirna College first time, I met liz collar who is international student coordinator. She is very kind to me, and she encourage me join SRC, I went to SRC meetings regularly all the time, but I didn’t even know what SRC was! That is the reason why I told her, I don’t want to go to SRC anymore. But she said “why not? You should go and you have to go!”I asked” why?” she said:” because I said so!”
But as ii receive this award today, I want to thank her. She helps me a lot.
Truth be told, I am not the best student in Wantirna College, but I appreciate this award and I will try my best in future.

But there is also bad influence. Some of the young teenagers are addicted to computer games, and some even play games all night. Because of lacking in sleep, those students can not focus on in the class . As a result, they may fail in the exam. When they realize it is wrong to spend too much time playing games, it’s already too late.
I have remembered such a piece of news . An excellent student flunked (考试不及格) because he could not concentrate on his study for being too indulged in computer games. He spent nearly all the money on games, which was earned by his father's selling blood. When his father knelt down to beg him to return to school, he was too numb to show any regret.
The most serious harm of computer games come from their contents, which affects teenagers ' mental health. Many games involve violence, such as fighting and killing. When they enjoy the pleasure of success, a violent turn of mind is developed and rooted in them, which may induce future violent behaviour in their life.
So when computers' entertaining function is highly spoken of ,such a problem does deserve our serious concern.
In addition, long time's working before computer also does harm to health. The radiation from the computer can arose many uncomfortable feelings., like a headache, poor eyesight.
At last, people who are fond of making friends on line should also be careful. Many convicts use Internet as a way to cheat. Although it has many disadvantages , Internet has become an indispensable part of people's life in recent years. In my point of view, it’s wrong to blame Internet itself, it’s all depend on the way we use it. If we use it in a right way, it can be one of the best friends in our life.

January first. The beginning of a new year. As far back in history as we can tell, people have celebrated the start of a new year.
The people of ancient Egypt began their new year in summer. That is when the Nile River flooded its banks, bringing water and fertility to the land. The people of ancient Babylonia and Persia began their new year on March twenty-first, the first day of spring. And, some Native American Indians began their new year when the nuts of the oak tree became ripe. That was usually in late summer.
Now, almost everyone celebrates New Years Day on January first. Today, as before, people observe the New Years holiday in many different ways.
The ancient Babylonians celebrated by forcing their king to give up his crown and royal clothing. They made him get down on his knees and admit all the mistakes he had made during the past year.
This idea of admitting wrongs and finishing the business of the old year is found in many societies at new years. So is the idea of making resolutions. A resolution is a promise to change your ways. To stop smoking, for example. Or to get more physical exercise.
Noise-making is another ancient custom at the new year. The noise is considered necessary to chase away the evil spirits of the old year. People around the world do different things to make a lot of noise. They may hit sticks together. Or beat on drums. Or blow horns. Or explode fireworks.
Americans celebrate the New Year in many ways.
Most do not have to go to work or school. So they visit family and friends. Attend church services. Share a holiday meal. Or watch new years parades on television. Two of the most famous parades are the Mummers Parade in Philadelphia, Pennsylvania, and the Rose Parade in Pasadena, California. Both have existed for many years.
Americans also watch football on television on New Years Day. Most years, university teams play in special holiday games.
For those who have been busy at work or school, New Years may be a day of rest. They spend the time thinking about, and preparing for, the demands of the new year.
